The first day of Christmas is, in fact, December 25. Christmas Day is not the twelfth day of Christmas, but January 6, Epiphany, is.

Yes, yes there are. And a depressing number of them work in marketing, and perpetuate the "twelve days of Christmas end on Dec 25" myth all over the place. Take a poll of some number of random people on the street or wherever - chances are, most will get it wrong.
