1) If that's true, then what do they think qualifies as a non-infringing use? I'd like to see some examples of what's A-OK, assuming any exist.

What they think is okay? I'd imagine they'd really like something where you automatically pay them 95 cents whenever you're within earshot of something that is playing music for more than half a second.
